Welcome to DynamicSkyShows.com (“Website”). By accessing or using our Website, submitting an inquiry, booking a drone show, requesting a quote, paying an invoice, or communicating with Dynamic Sky Shows in any way, you agree to these Terms & Conditions (“Terms”).

If you do not agree, do not use our Website or services.

1. Acceptance of Terms

By visiting our Website, submitting a form, booking services, or engaging with Dynamic Sky Shows, you confirm you have read, understood, and agree to these Terms. Additional written terms contained in a proposal, invoice, or change order may apply to your specific project. If there is a conflict, the signed proposal/invoice terms control for that project.

3. Services Provided

Dynamic Sky Shows offers services including (but not limited to):

Drone light show productions

Event design and aerial choreography

Visual pre-visualizations and renderings

Sponsorship activations

Community, corporate, city, and private event drone shows

All services are subject to availability, weather, FAA regulations, airspace restrictions, safety requirements, and venue approvals.

4. Quotes, Scope & Changes

Quotes are based on the information you provide (event date/time, location, crowd size, venue layout, airspace conditions, creative requirements, etc.). Any change to scope (date/time/location, drone count, animations, logos, approvals, schedule, or venue layout) may require a re-quote and/or written change order and may increase cost.

5. Pricing & Payments

Pricing varies based on the number of drones, location, event type, custom animations, and production requirements.

A deposit may be required to secure an event date. Dates are not reserved until the deposit clears and your proposal/invoice is accepted.

Remaining balances must be paid according to the agreed invoice terms.

Past-due balances may result in suspension of work, postponement, or cancellation.

Dynamic Sky Shows reserves the right to update pricing at any time; changes do not affect booked events unless scope changes.

6. Cancellation & Rescheduling Policy

All cancellation or rescheduling requests must be submitted in writing.

Deposits may be non-refundable depending on production timelines, staffing, travel, permitting work, programming, and preparation already completed.

Rescheduling is subject to availability and may require additional fees.

Weather-related postponements will be assessed case-by-case. Alternative dates or delay windows may be offered when possible.

Dynamic Sky Shows is not liable for cancellations or delays due to:

High winds

Precipitation, fog, lightning, or low visibility

FAA airspace restrictions or other regulatory limitations

Venue or third-party issues

Unforeseen safety concerns

7. FAA Compliance & Safety

All drone operations are conducted in accordance with applicable FAA rules and safety standards. Dynamic Sky Shows reserves the right to delay, modify, reschedule, or cancel a show if conditions do not meet mandatory safety requirements.

Client agrees the event space must comply with required safety buffers, crowd distancing, launch/landing zones, and airspace/venue restrictions. Client is responsible for coordinating with venue staff/security to keep restricted areas clear.

8. Permits, Venue Approvals & Third Parties

Some events may require permits, permissions, and/or coordination with municipalities, venue management, or third parties. Unless explicitly stated in writing, Client is responsible for venue permissions and any non-FAA local permits required by the venue or municipality.

We are not responsible for delays or failures caused by third parties (venue denial, permit delays, power outages, security issues, or other vendors).

9. Intellectual Property Rights

All drone show designs, animations, renderings, pre-visualizations, choreography, website content, images, and branding belong to Dynamic Sky Shows (or its licensors) and are protected by copyright and other intellectual property laws.

Clients may not reproduce, resell, distribute, or reuse show content without prior written permission from Dynamic Sky Shows.

10. Media Release (Photos & Video)

Unless you notify us in writing before the event, you grant Dynamic Sky Shows permission to capture and use photos/videos of the event and show for marketing, portfolio, website, and social media purposes.

11. Messaging & Communications Consent (A2P/TCPA)

By providing your phone number and/or email address through our Website, booking forms, lead forms, chat, checkout pages, or any other method, you consent to receive communications from Dynamic Sky Shows, including for customer service, scheduling, service updates, and (if you opt in) marketing/promotional messages.

Communications may include:

SMS/MMS text messages

Phone calls (including autodialed calls and/or pre-recorded/artificial voice messages where permitted by law)

Email and other digital communications

Consent is not a condition of purchase.
Message frequency varies based on your interaction with us.
Message and data rates may apply.
Carrier delivery is not guaranteed.

Opt-Out and Help (Required)

You can opt out of SMS at any time by replying:

STOP to cancel/opt out

HELP for help

After you reply STOP, you may receive one final message confirming your opt-out. If you opt out of texts, we may still contact you by other methods you provided (such as email), unless you request removal.

12. Website Use & Prohibited Conduct

Users agree not to:

Engage in fraudulent activity

Copy or misuse website content

Attempt to hack, disrupt, or interfere with website functionality

Upload malicious code or files

Violations may result in blocked access and legal action.

This service is not directed to individuals under the age of 18. By using the service, you represent and warrant that you are at least 18 years old.

13. Limitation of Liability

Dynamic Sky Shows is not responsible for:

Damages resulting from weather, regulatory restrictions, or technical delays

Website malfunction or downtime

Third-party vendor failures

Indirect, incidental, special, or consequential damages, including loss of profits or event-related financial impact

Our maximum liability is limited to the amount paid to Dynamic Sky Shows for the specific service in question.

Our Website may contain links to third-party sites. We are not responsible for their content, privacy practices, or operations.

15. Privacy

Your use of our Website and services is also governed by our Privacy Policy.

16. Amendments to Terms

Dynamic Sky Shows may update or revise these Terms at any time. Changes are effective immediately upon posting on the Website.

These Terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes must be brought in the state or federal courts located in Massachusetts unless otherwise agreed in writing.
